In spite of the fact some were aware of previous problems with Tony it doesn't mean XXL did anything wrong by choosing to deal with him. It may have been ill advised but his intentions were simply to pay a fair price for a good job. XXL kept his end of the bargain whether it was a good bargain or not, Tony didn't and has offered not legitimate reason.
I don't get the immpression XXL suckered Tony into a no-win price then held him over the barrel to squeeze all he could out of the deal. In fact it seemed XXL was quite willing to pay what he had to in order to get a great job but it wasn't even an option.
There's only one victim here and he's stuck with a cab he can't live with and a $4000 hole in his account.
