uninsured driver

on 8/15 a uninsured driver turned left into me. I never even had time to react.
I was shifting from 3rd to 4th when the wreck happened, she was cited for failing to yield while making a left turn and driving with out insurance.
My truck is totaled I think she floored it to try and beat me.Name:  totaledtruck3.jpg

I hope she was driving a little ricer that also got totaled. Good that you're OK(?) but sorry about your truck. Hopefully your insurance company will work with you on the replacement value. Stinks about having to do all that work for somebody else's mistake, though.

Glad your ok . Hopefully you have collision or uninsured/underinsured coverage . If not you could sue but most likely she has squat .

Thank you I have collision, I don't think its going to get fixed, I am going to try and find another 67 to put my running gear in.

Still working with my insurance not sure what's going to happen I have never had to deal with this. She was driving a 2013 ford fiesta it looked totaled.

Damn! I hope that you get those teeth fixed for free! Besides the pain, of course. There's no compensation for that, generally.

I feel your pain. I had the exact type of accident in 1972. A girl turned in front of me trying to get into a gas station. My car hit was hit by hers right between the two left hand head lights. Totaled both cars. I short time ago another person on this forum had his truck totaled. His insurance company was trying to screw him on the value. He got an independent restored vehicle appraisal on his truck that was way higher than the insurance companies first offer. See if you can find his post and find out how to get such an appraisal of your "restored" truck.

What shocks me is the amount of damage that was done to one of our tanks when you consider that it was a modern day vehicle that hit it.. That is very bad. I'm so glad that you were not injured worse

These trucks (and most old cars) aren't really that tough. Ever see the video of the newer impala being crashed into the older impala?

Very sorry for your injuries.
I wouldn't write the truck off so quickly. There might not be a great deal of frame damage.

Hire an attorney . Always over insure yourself , She probably had no insurance but was carrying a $1,200.00 cell phone .

+1 Get an attorney. You're the victim of their blatant negligence, make them pay for their stupidity and it will offset your loss 10 fold what you can get on your own. It is infuriating how often people don't have insurance. Grumpy is right, most folks now a days easily have 1-2500$ in their pocket (or in their hand...) while driving. Everyone with a$$ in seat has no excuse to be uninsured. Getting an attorney will just cost you a 1/3rd commission of what ever you get. Dont fool yourself into thinking you can get anywhere close on your own, no matter how blatant their bs is.

The penalty for doing that should be 10 years/100k fine and permanent loss of license. Same story with DUI. See how long people keep that crap up. but anyway...

Speaking from experience. The truck I've been driving for 6 years was paid for with a settlement I got after an idiot who made similar decisions. Next on my list is one of those car cameras.

You are screwed. I have fixed worse damage than that at home. Pull the front clip off and have the frame work done. Probably zeed the frame some and bent the horns on both side's. No big deal. That truck would be totalled on the cost of the paint alone. core support, hood, fender, bumper with brackets, radiator,grill, headlight , assorted trim and fasteners. Give you something to do this winter. Don't waste your time trying to get blood from a turnip. No one is held accountable for their actions anymore. Good luck.

I rebuild wrecks for a living and have had since 1987. Your truck could be a total to somebody who doesnt care about it but to you I'm sure it is worth a lot more than it would be to someone else. I say it would be the right thing to do to pull the front [if you are able] and have someone look at your frame. The modern[er] frame machines will pull that frame like it is playdoh or something. I know my machine will tear one in half if I crank it up. parts wont be a problem either they can all be had new while there still are some used ones around. I have frames and front parts [not really for sale and dont want this thread to lean that way]. Just saying that if I have them others do too. Good luck hope all turns out well Jim

At least in my state, paint and electronics cannot be part of the totaled or not calculation

Agree. While it looks bad, I would remove the front clip, and look if the frame has significant damage. A good frame shop might be able to pull things back in line fairly easily, then you could simply replace front sheet metal. I once hit a deer with a Suzuki Sidekick at 60 MPH, and it looked hopeless, and those do not have a frame, but I purchased some front sheet metal from a salvage, new water pump, radiator, and used a come-along to pull things back in line and put it back on the road. Drove it several years, then sold it for more than I bought it for. I did similar to my daily driver when I got rear ended and pushed into someone else in the crash. The drivers insurance paid me $1400 and said it was totalled (Camry with over 300,000 miles at the time). Car still run/drove fine, so I kept the car, put about $400 into salvage parts and paint, spent one day labor myself, and still drive it about 3 years later. Your truck does look like frame is tweaked though, but worth further investigation.

My wife watches Judge Judy once in while, and I have recently seen 2 cases where uninsured drivers caused accidents, law enforcement shows up and writes a report, but they don't ticket or do anything to the uninsured even though by law they need proof of insurance.

One guy actually thought that since law enforcement didn't do anything, that it must be okay to drive without insurance. And the victims are left having to deal with it in court.

I'm going through the uninsured motorist hassle myself right now, although my Burban is no where near as damaged as your truck is. The claims adjuster did tell me that since they are unable to contact the POS who caused the wreck, once the totals from both vehicles he damaged in the wreck are completely known they will turn the bill over to a collection agency. There's no escaping from them. (Don't ask how I know.) So there is some sliver of justice.

Several years ago I was involved in an accident. I was the unissured driver and the accident was my fault. The Texas attorney general office came after me for causing the accident and revoked my drivers license. I had to jump through many "legal" loop holes to get my license back to legal. I also had to pay court costs, lawyer fees, and pay out two claims to the tune of "$11,000+.

It was an ordeal and I didn't just get out of it for nothing. This was in Texas. Maybe, just maybe the offending party will come through and do the right thing.

This sound similar to what NH does. You can drive without insurance, but if you cause an accident they can suspend your license until you pay restitution to the other driver/s. That could take a long time if there are medical bills.

Nothing leaves my driveway without proper insurance.
