From the comment you just made I hope someone from the insurance company doesn't pay the towing and storage fees and grab the truck.. Ryan offerd to store it fro you so legally do yiou have the right to get it from the salavage yard and take control of yoiur truck> You do have the title ..

That is waht I was figuring and yes I forgot he'd have to pay the fees but could recoup when deal is settled.

Last week I spoke to the Wapello county sheriff and he said George will need to get a lawyer involved. He will need to contact the Jasper county Sheriff's department and see if they have any info about the accident and talk to them and see if they can help him get it back. The Wapello county sheriff said this is a civil matter and they aren't allowed to get involved with civil matters. Only criminal matters. This whole situation is almost theft IMO which would be criminal I'd think. Apparently that isn't how it works from what I was told though.

Last week I tried searching the reported wrecks along I-80 and found nothing reported about this particular wreck on May 17th. I'm not sure if it was wrecked in another county and since Barney's was called they drug it back to their yard and that's how it got to Jasper county?

That is the first thing I told George to do. Try to pay the tow bill and storage fees to Barney and get your truck released. But I guess he, Barney, won't release it until the insurance company releases it. This is the whole thing I don't understand how they can do this. They insured the truck and load during transportation through the owner/company of the trucking company. Apparently that entitles them to owning it since it is wrecked now and is considered part of the load? I'd say no especially since they haven't settled with him on any part of it. it's cheaper for them to keep it and cut you a check , that's why I suggested calling an attorney last week . I suggest you hire one in the town it's currently in before it's gone . The time for being nice has ended .

They may already own it , read the fine print in your contract , it may include a "mechanic's lien" like every other contract you sign from a muffler shop to a new car dealer on repair orders .

The towing company CANNOT HOLD YOUR TRUCK !!! The owner can get his truck from the towing company whenever he wants to. The insurance company does not own the truck.

IN SOUTH CAROLINA A TOWING COMPANY CANNOT CHARGE STORAGE UNTIL 5 DAYS AFTER THE MAILING OF CERTIFIED MAIL.DON'T MATTER HOW MANY TIMES YOU'VE CALLED THEM.
You should call a magistrate in the area to get the scoop on their laws. Call Barney and tell him you have a friend that's coming after the truck. If he gives u any crap tell him you are going to the magistrate and you are calling the highway patrol to file a complaint. Nobody
Except you has any legal rights to the truck.PERIOD.

Sometime today I will call Barney and ask him what it would take to get my truck into Ryan's hands. I have a colonoscopy scheduled for tomorrow and I am not looking forward to the prep I have to do later on today. I won't be in great shape for making any calls tomorrow either. I am sure Barney has dealt with this before. I would just like hear him tell me what he can or cannot do for me at this point. Then if I need to get a lawyer involved I can tell him exactly what sort of help I need. Once again, thanks for all the support.

And yes, you are right Ryan. I think the accident occurred on exit 76? It was down the road aways and probably not in Barney's county.

WOW! I think the back window tells me what the owner is smoking. It says "WILD BILL TATOO". He must be high on something. I cannot imagine anyone paying what he wants for this truck-- and it is not a short bed either. I appreciate you keeping me informed!

George, that truck only has 2 stake pockets. I'm pretty sure it is a short bed. Good luck with your procedure too.

Well ... By now you may have had the time to contact an attorney only to hear the costs to try to save it from the salvage auction may be prohibitive ? And if he was able to save it for you it would have a salvage title ? I wish you the best but when these larger haulers with large insurance policies and corporate attorneys it just may not be worth all the costs involved ? Maybe he can negotiate a good payoff for you ?

Thanks MM. Colonoscopy went better than ever. Found only one very tiny polyp smaller than a pinhead, so now I do not have to come back for another 5 years, age 71. Not telling what to do but ......pay the $600 and get your truck out of there and save the receipt. What if the insurance company drags their feet for a month only to offer you $2500
Storage will eat it up quick and if Barney has not sent you certified mail he can't charge storage...

Hi georgieb51, I have been watching this thread with interest. I'm sorry to hear about your "total" loss. If it were me, I think I would just get the truck out of there ASAP and back into my hands, let the paperwork be "messed up" by $600 worth after paying the storage fees, and let the insurance company either pay me something for the loss, or not, later.

I'm with everyone else get it the heck out of there.
Last people I would trust is an insurance co. and some guy I never met.
If you need help with the $600.00
I'll donate a few bucks to your cause . I hate to see a guy and his truck getting jerked around .
